DrySmart Four Year Limited Warranty

DrySmart, LLC warrants this product and its parts against defects in materials or workmanship for four years as follows:

New replacement on all DrySmart products for one year.

During this period, DrySmart, LLC will replace defective items with new ones without charge to you, subject to the provisions below.

Refurbished replacement on all DrySmart products for four years.

During this period DrySmart, LLC will replace defective items with new or refurbished items, at its sole discretion.

In either case, the warranty will cover the replacement units through its original term.

The warranty period commences when the product is shipped. This warranty covers material defects in construction and workmanship, or units that will not function, e.g., unit will not power up, such as failure to stop the dryer, or failure to disable dryer heat. It does not cover performance issues, such as energy saved.

Shipping fees incurred from returns for under warranty service during the first year will be paid by DrySmart, LLC.  After the first year, all shipping fees both to and from DrySmart, LLC must be paid by the customer. All returns, both during and following the first year, must be affected via the Procedures for Obtaining Warranty Service described below.

All parts returned to DrySmart, LLC for a warranty claim, and replaced by DrySmart, LLC, become the property of DrySmart, LLC. Any aftermarket or user additions or modifications will void the warranty.

WiFi, ISP, and/or Cellular network service, used for uploading DrySmart log data are not covered. The owner is solely responsible for maintaining adequate functional Internet access, at its sole expense.

DrySmart, LLC makes no other warranty, either expressed or implied, including but not limited to usefulness, effectiveness, functionality, merchantability, fitness for a particular purpose, or conformity to any representation or description.

DrySmart, LLC makes no warranty or representation, either express or implied, with respect to any third party manufacturer’s product or documentation, its quality, performance, merchantability, fitness for a particular purpose, or conformity to any representation or description.

Except as provided below, DrySmart, LLC is not liable for any loss, cost, expense, inconvenience or damage that may result from use or inability to use a covered product. Under no circumstances shall DrySmart, LLC be liable for any loss, cost, expense, inconvenience or damage exceeding the purchase price of the product.

The warranty and remedies set forth below are exclusive and in lieu of all others, oral or written, expressed or implied. No reseller, agent or employee is authorized to make any modification, extension or addition to this warranty.

 

Warranty Conditions

The above Limited Warranty is subject to the following conditions:

  1. This warranty extends only to products distributed and/or sold by DrySmart, LLC. It is effective only if the products are purchased and operated in the USA.
  2. This warranty covers only normal use of the products. DrySmart, LLC shall not be liable under this warranty if any damage or defect results from (i) misuse, abuse, neglect, improper shipping, or installation; (ii) disasters such as fire, flood, lightning or improper electric power source; or (iii) service or alteration by anyone other than an authorized DrySmart, LLC representative.
  3. The serial number on any returned product must be intact, legible, and unaltered, to receive warranty service.
  4. No warranty extension will be granted for any replacement products furnished to the purchaser in fulfillment of this warranty.
  5. DrySmart, LLC and its Authorized Service Center(s) accept no responsibility for any data or information stored on any media or any parts of any products returned for repair to DrySmart, LLC.
  6. This warranty does not cover any third party software or malware related problems.
  7. DrySmart, LLC makes no warranty either expressed or implied regarding third party software.

 

DrySmart Software

The DrySmart iOS App, is available at no charge on the Apple App Store. This app is provided on a strictly as is basis. No warranty of any kind is expressed or implied regarding usefulness, effectiveness, functionality, merchantability, fitness for a particular purpose, or conformity to any representation or description.

DrySmart, LLC is not responsible for any loss of work (“down time”) or consequential damages of any kind attributable in any way to the DrySmart iOS App, other than refund or remuneration of the original sale price of purchased DrySmart hardware products. Any such refund shall be subject to return of all refunded products.

 

Procedures for Obtaining Warranty Service

RMA (Returning Merchandise Authorization) Policy:

To return a defective product, please contact our Customer Service Department for a Return Merchandise Authorization (RMA) number and follow the Return of Products Instructions below. The RMA is valid for 10 days from date of issuance. Returns will not be accepted without an RMA.

The serial number on any returned product must be intact, legible, and unaltered.

RMA numbers and services are rendered by DrySmart, LLC only. Any shipping costs, after one year from the original shipping date, on any item returned for warranty claim is the customer’s responsibility.

All returned parts must have a RMA number written clearly on the outside of the package, along with a letter detailing the problems.

No COD packages will be accepted. No package will be accepted without a RMA number written on the outside of the package. RMA numbers are valid for 10 days from the date of issue.

Pack the product in its original box or a well protected box. DrySmart, LLC will not be responsible for shipping damage/loss of any product outside the original one year DrySmart, LLC paid service period. We recommend that you ship returned products insured.

Upon receiving the product, DrySmart, LLC will ship a replacement to you within two weeks (dependent on parts availability) via carrier of its choice.

If the defective item is determined to have failed to abuse, such as being dropped, or subject to external overheating, it will be returned. You will be notified via email and/or phone call of the return.

 

Cross Exchange Service

If you prefer not to wait for normal shipping and replacement turnaround, we offer Cross Exchange Service to expedite replacement:

You will need to provide a valid credit card number as a deposit guarantee when the RMA number is issued. Once approval has been obtained on your credit card, the requested replacement item will be shipped via Ground service by carrier of our choice. You may request two day or overnight shipping at your expense, subject to replacement item availability.

You will need to ship defective part(s) back to DrySmart, LLC within 15 days to avoid charges to your credit card. If the defective items are not received at DrySmart LLC within 15 days after the replacement item was shipped, or if the returned item is not defective or is determined to have failed due to abuse, such as being dropped, or subject to external overheating, your card will be billed. You will be notified via email and/or phone call of the transaction.

If such charges are incurred, the replacement item will be billed for at its then current price, plus a 20% service fee.

 

Post Warranty Repair

For post warranty repair, the procedure is the same as outlined above for an RMA and shipping. However, you are responsible for shipping charges both ways. Repairs will be billed at our then current labor rate, plus components as needed. You will be advise of the current labor rate, and estimated charges before we commence repair.

 

Warranty Exclusions

DrySmart, LLC does not offer technical support for any third party software including installed OS or other programs. Technical support should be pursued through channels offered by the software’s individual tech support. DrySmart, LLC accepts no liability for problems caused by aftermarket software, hardware modifications, or additions.

DrySmart, LLC is not responsible for loss of data or time, even if related to hardware failure.

DrySmart, LLC is not responsible for any loss of work (“down time”) caused by a product requiring service. This warranty is null and void if the defect or malfunction was due to damage resulting from operation not within manufacturer specifications. It will also be null and void if there are indications of misuse and/or abuse. DrySmart, LLC has the option of voiding the warranty if anyone other than an DrySmart, LLC technician attempts to service the product.

DrySmart, LLC will not warrant any problems arising from an act of God (lighting, flooding, tornado, etc.), electrical spikes or surges, or problems arising out of hardware, software, or additional devices added to complement any item purchased from DrySmart, LLC.

Under no circumstances will DrySmart, LLC be responsible for any consequential damages, or any refund or remuneration exceeding the original purchase price of the product, less any shipping fees. DrySmart, LLC will not be held responsible for typographical errors on sales receipts, repair tickets, or on our website.

 


DrySmart Privacy Policy

Section 1 – Information Collection and Use

When you register with us, we may ask for your name, eMail address, company, address, title, function, financial data, industry, credit card, etc., as applicable.

When you purchase something from us, as part of the purchase and sale process, we collect the personal and/or business information you give us such as your name, address and eMail address, and credit card data.

Once you provide any of this information, or submit any subset of your personal or business information, you are not anonymous to us.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

We may collect personally identifying information when certain features of our website are used, such as, but not limited to, registering for an event, submitting or requesting online information through forms or eMail, requesting or accessing personal or client specific information, or visiting certain website pages.

We may also receive personally identifiable information from our business partners, online or offline.

We may save and access our cookies on your computer. We may use this information for tracking site demographics, tracking orders, and other purposes as needed to transact business.

We may also automatically receive and record information on our server logs from your browser including your IP address, our cookie information, and the page you requested.

We may also collect DrySmart Log Data from each DrySmart unit purchased. This data is used for Analysis Reports we send to individual customers from time to time. We occasionally share this data with third parties, at our sole discretion, for establishing and/or confirming DrySmart performance, and for use by energy Utilities and their partners.

We identify such data only with information such as the Type, Size or Laundry Volume, Number and Type of Dryers, City, and State of each customer site. We do not share customers’ personal or business information for these purposes.

With your permission, we may send you eMails about new products and other updates.

 

Section 2 – Consent

How do you get my consent?

When you provide us with personal information, such as to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with a clear opportunity to say no.

 

How do I withdraw my consent?

If after you opt in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us, at the eMail or post office address listed at the end of this document.

 

Section 3 – Information Sharing and Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

DrySmart, LLC will not sell or rent your personally identifiable information to anyone.

DrySmart, LLC will only send personally identifiable information about you to other companies or people when:

We have your consent to share the information.

We need to send the information to companies who work on behalf of DrySmart, LLC. to provide a product (hardware or software) or a service to you (unless we tell you differently, these companies do not have any right to use the personally identifiable information we provide to them beyond what is necessary to assist us) .

We respond to subpoenas, court orders or legal process.

We find that your actions on our web sites violate the DrySmart, LLC Terms of Business.

 

Section 5 – Third Party Services

In general, the third party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our website or are redirected to a third party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

In no case shall DrySmart LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless DrySmart LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

 

Section 16 – Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

Section 17 – Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
